BY-LAW NUMBER 27-2004
 
A by-law to revise the Qualitative Sanitary Sewer Surcharge Rate and Sewer Waste Disposal Charge



WHEREAS the Council of the Regional Municipality ("Regional Corporation") on November 22, 1990, passed By-Law 90-90 to regulate the discharge of matter into the sanitary and storm sewage systems of the Regional Corporation and to make provision for the establishment of sewer rates and charges for use of its property, and for services and activities provided by the Regional Corporation.

AND WHEREAS the Council of the Regional Corporation on December 12, 2002, passed By-Law 66-2002, being an omnibus User Fee By-Law to impose fees for services and activities provided by the Regional Corporation;

AND WHEREAS By-Law 66-2002 imposes the qualitative sewer surcharge rate and establishes sewer waste disposal charges;

AND WHEREAS Ontario Regulation 244/02 under the Municipal Act, 2001, imposes enhanced public notification requirements in the case of waste management, water and wastewater system charges and fees;

AND WHEREAS the Council of the Regional Corporation has by resolution adopted on February 12, 2004, authorized that By-Law 66-2002 be amended to delete the waste management, water and wastewater system charges and fees, which amendment is being effected pursuant to a by-law separate from the by-law herein;

AND WHEREAS the Council of the Regional Corporation has by resolution adopted on February 12, 2004, authorized the enactment of wastewater rates and charges in accordance with Schedule A attached hereto;


NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

1. That the Qualitative Sanitary Sewer Surcharge Rate set out in Schedule A hereto is hereby established, adopted and enacted for the purposes of By-Law 90-90 and for such other purposes as for which the enactment of a Qualitative Sanitary Sewer Surcharge Rate may be required.

2. That the Sewer Waste Disposal Charge set out in Schedule A hereto is hereby adopted, enacted and imposed for all purposes as for which the enactment of a Sewer Waste Disposal Charge may be required.

3. The Qualitative Sewer Surcharge Rate and Sewer Waste Disposal Charge on the day immediately prior to the day this by-law comes into effect, shall continue in effect to but not including the date upon which this by-law comes into effect.

4. This By-law may be referred to as the "Sewer Surcharge Rate and Sewer Waste Disposal Charge By-Law, 2004."

5. This By-law takes effect on the day that it is passed.

Schedule A to By-Law 27- 2004

That the rates set out below are effective for all accounts rendered from the passing of this by-law.

1. Qualitative Sanitary Sewer Surcharge Rate: $219.97 per 1000 cubic meters

2. Sewer Waste Disposal Charge: $9.75 per 1000 gallons
