THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 31-2006
 
A by-law to authorize the construction of a sanitary sewer on Creditview Road, Churchville Road, Martin's Boulevard and Hallstone Road in the City of Brampton, and to undertake such work as a local improvement.

WHEREAS the owners of properties abutting on Creditview Road, Churchville Road, Martin's Boulevard and Hallstone Road in the City of Brampton, as set out in Schedule A to this by-law, have petitioned for the construction of a sanitary sewer on Churchville Road (South of Steeles Avenue), Creditview Road (South of Steeles Avenue to the intersection of Creditview Road and Churchville Road to Highway 407), Hallstone Road (from property 1553 to Creditview Road), Martin's Boulevard (from Victoria Street) in the City of Brampton, hereinafter referred to as "the Work";

AND WHEREAS the Deputy Clerk has certified that the petition for undertaking the Work as a local improvement is sufficient pursuant to the requirements set out in Ontario Regulation 119/03, Local Improvement Charges - Priority Lien Status, filed under the Municipal Act, 2001, hereinafter referred to as "the Regulation";

AND WHEREAS notice of the Region's intention to pass a by-law to undertake the Work as a local improvement at the meeting of Regional Council on June 8, 2006, was given to the public and to the owners of the lots liable to be specifically charged on May 24, 2006, in accordance with section 3 of the Regulation;

AND WHEREAS the Council of the Regional Corporation has by Resolution 2006-208, passed on the 18th day of May, 2006 authorized the construction of the Work under Capital Project 06-2730;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

That the Regional Corporation shall construct the Work at a total estimated cost of $2,120,000;

  1. That the Regional Corporation shall undertake the Work as a local improvement for the purpose of raising part of the cost of the Work by imposing special charges on lots abutting on the Work in accordance with the provisions set out in the Regulation;

  2. That the Commissioner of Public Works or the consulting engineer for the Regional Corporation shall take such action as may be necessary for the preparation of a contract or contracts for the execution of the Work under their supervision;

  3. That, pursuant to the Regulation, the total cost of the Work shall be financed as follows:

    a) the owners' share of the cost, estimated at approximately $786,594.25, which will be comprised of the sum of $175 per metre of assessable frontage plus a mandatory connection fee of $1,550, shall be specially charged upon the land abutting directly on the Work, as set out in Schedule A attached hereto; and

    b) the remainder of the total cost of the Work, estimated at approximately $1,333,405.75 shall be borne by the Regional Corporation, from the Wastewater Capital Financing Stabilization Reserve (R0242).
