THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 34-2006
 
A by-law to authorize the construction of a watermain on Mississauga Road from the existing watermain located at the intersection of Mississauga Road and Sevenoaks Drive north to 2725 Mississauga Road, in the City of Mississauga, Ward 8, and to undertake such work as a local improvement, and to repeal By-law 104-2005.

WHEREAS The Regional Municipality of Peel, herein after referred to as "the Regional Corporation", has initiated the construction of a watermain to service properties abutting on Mississauga Road from the existing watermain located at the intersection of Mississauga Road and Sevenoaks Drive north to 2725 Mississauga Road, City of Mississauga, hereinafter referred to as "the Work";

AND WHEREAS the Regional Corporation has initiated the Work in accordance with Section 2(1) of Ontario Regulation 119/03, Local Improvement Charges - Priority Lien Status, filed under the Municipal Act, 2001, hereinafter referred to as "the Regulation";

AND WHEREAS notice of the Regional Corporation's intention to pass a by-law to undertake the Work as a local improvement, at the meeting of the Council of the Regional Corporation on July 6, 2006, was given to the public on June 1, 2006 and to the owners of the lots to be specially charged, on June 17, 2006, in accordance with section 3 of the Regulation;

AND WHEREAS the Council of the Regional Corporation has by Resolution 2006-558, passed on the 8th day of June, 2006, authorized the construction of the Work under Capital Project 05-1705;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

  1. That the Regional Corporation shall construct the Work at a total estimated cost of $310,000;

  2. That the Regional Corporation shall undertake the Work as a local improvement for the purpose of raising part of the cost of the Work by imposing special charges on lots abutting on the work in accordance with the provisions set out in the Regulation;

  3. That the Commissioner of Public Works or the consulting engineer for the Regional Corporation shall take such action as may be necessary for the preparation of a contract, or contracts, for the execution of the Work under their supervision;

  4. That, pursuant to the Regulation, the total cost of the Work shall be financed as follows:

    a) the owners' share of the cost, estimated at approximately $74,356 which will be comprised of the sum of $289 per metre of assessable frontage, shall be specially charged upon the land abutting directly on the Work, as set out in Schedule A attached hereto;

    b) the remainder of the total cost of the Work, estimated at approximately $235,644 shall be borne by the Regional Corporation, from the Water Capital Financing Stabilization Reserve (R0241);

  5. That By-law 104-2005, be repealed.
