THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 40-2006
 
A by-law to authorize the execution of a Municipal Funding Agreement for the Transfer of Federal Public Transit Funds with the Association of Municipalities of Ontario ("AMO") which will allow AMO to release the federal public transit funds to the Region of Peel.

 

WHEREAS on March 30, 2006 the Government of Canada, and Ontario municipalities as represented by the Association of Municipalities of Ontario ("AMO") executed the Agreement for the Transfer of Federal Public Transit Funds (the "PTF Agreement");

AND WHEREAS the PTF Agreement includes specific provisions on the Public Transit Funds to primarily support investments in public transit infrastructure;

AND WHEREAS the Regional Municipality of Peel has been allocated a total of $51,005 for 2005/2006 and will be allocated additional funds in future years;

AND WHEREAS the PTF Agreement requires the Regional Municipality of Peel to execute a Municipal Funding Agreement for the Transfer of Federal Public Transit Funds (the "MFA") with AMO, included as Schedule A of this by-law;

AND WHEREAS the Regional Municipality of Peel will be required to provide AMO with an annual expenditure report due by March 31st following the Municipal Fiscal Year;

AND WHEREAS the Regional Municipality of Peel will be required to provide an annual audit statement as defined in the MFA;

AND WHEREAS the Regional Municipality of Peel will be required to provide an accounting for outcomes achieved as a result of investments made with public transit funding through an Outcomes Report to be made available publicly;

AND WHEREAS AMO has produced the MFA and requires its execution and return prior to the release of the public transit funds to the Regional Municipality of Peel:

NOW THEREFORE the Council of the Regional Municipality of Peel enacts as follows:

  1. That the Regional Chair and Regional Clerk are authorized to execute a Municipal Funding Agreement for the Transfer of Federal Public Transit Funds between the Association of Municipalities of Ontario and the Regional Municipality of Peel substantially in the form of Schedule A attached hereto.

  2. That Schedule A forms part of this by-law.
