THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 1-2009
 

A by-law to authorize the construction of a sanitary sewer on Portway Avenue, including 1500 Ifield Road, in the City of Mississauga, Ward 8, and undertake such work as a local improvement.


WHEREAS, the owners of properties abutting on Portway Avenue in the City of Mississauga, as set out in Schedule A to this by-law, have petitioned for the construction of a sanitary sewer on Portway Avenue from 2018 Portway Avenue to 2144 Portway Avenue, including 1500 Ifield Road, in the City of Mississauga, Ward 8, hereinafter referred to as "the Works";

AND WHEREAS the Regional Clerk has certified that the petition for undertaking the Works is sufficient pursuant to the requirements set out in Ontario Regulation 586/06 Local Improvement Charges - Priority Lien Status, under the Municipal Act, 2001, hereinafter referred to as "the Regulation";

AND WHEREAS notice of the Region's intention to pass a by-law to undertake the Works as a local improvement at the meeting of Regional Council on January 22, 2009, was given to the public on January 7, 2009 and to the owners of the lots on December 19, 2008, in accordance with section 3 of the Regulation;

AND WHEREAS the Council of the Regional Corporation has by Resolution 2008-1280 passed on November 20, 2008 authorized the construction of the Works under Capital Project 08-2706;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

  1. That the Regional Corporation shall construct the Works at a total estimated cost of $698,194.00 (excluding taxes);

  2. That the Regional Corporation shall undertake the Works as a local improvement for the purpose of raising part of the cost of the Works by imposing special charges on lots abutting on the Works and/or immediately benefiting from the works in accordance with the provisions set out in the Regulation;

  3. That the Commissioner of Environment, Transportation and Planning Services or the consulting engineer for the Regional Corporation shall take such action as may be necessary for the preparation of a contract or contracts for the execution of the Works under their supervision;

  4. That pursuant to the Regulation, the total cost of the Works shall be financed as follows:

    a) the owners' share of the estimated cost shall be $363,768.00, calculated in accordance with the Regional User Fees and Charges By-law, and being the sum of $450.00 per metre of assessed frontage, as set out in Schedule “A” attached hereto, and a mandatory connection fee of $2,100 per lot; and

    b) the Region’s share of the estimated cost shall be $334,426.00, and shall be financed from the Wastewater Capital Financing Stabilization Reserve (R0242), under Capital Project 08-2706.
