THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 17-2009
 

A by-law to provide for the Regional Corporation’s consent to permit an encroachment onto parts of Regional Road 50 in the City of Brampton.


WHEREAS Ouray Developments Inc., the owner of the lands and premises described as Part of Lot 5, Concession 10 Northern Division, City of Brampton (formerly Township of Toronto Gore), Regional Municipality of Peel, designated as Parts 2, 5 to 22 both inclusive, Parts 52 to 54 both inclusive, Parts 57 and 65 to 72 both inclusive on Reference Plan 43R-32167, has requested permission to maintain and use certain structures or improvements upon the public highway (the “encroachment”);

AND WHEREAS pursuant to Section 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 5th day of March, 2009 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

  1. That Ouray Developments Inc. are hereby authorized to maintain the encroachments upon the public highway known as Regional Road 50, as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement attached as Schedule “A” dated the 1st day of November, 2008 between The Regional Municipality of Peel and Ouray Developments Inc., and shown on a drawing filed in Region of Peel Real Estate File ENC-08117.00.

  2. That Schedule “A” attached to this by-law is included and shall be considered part of this By-law.

  3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Deputy Clerk.
