THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 38-2009
 

A by-law to amend By-law Number 63-2007 interpreting the by-laws of the Regional Municipality of Peel respecting changes to organizational structure and alignment.


WHEREAS By-law Number 63-2007 was enacted on May 31, 2007 to guide the interpretation of by-laws respecting changes to the organizational structure of the Regional Corporation which had taken effect as of June 1, 2007;

AND WHEREAS the Council has by Resolution 2008-1456 passed on December 11, 2008 authorized the Chief Administrative Officer to proceed with a re-alignment of the Corporate Services Department, the Employee and Business Services Department and the Office of the Chief Financial Officer;

AND WHEREAS it is desirable to amend By-law 63-2007 to further reflect the re-alignment of December 11, 2008;

NOW THEREFORE, the Council of the Regional Municipality of Peel enacts as follows:

1. That By-law 63-2007 is amended as follows:

1.1 The title of the by-law is repealed and the following is substituted therefor:

“A by-law to amend and interpret the by-laws and resolutions of The Regional Municipality of Peel respecting changes to the organizational structure of the Regional Corporation effective as of June 1, 2007 and the departmental re-alignment effective as of December 11, 2008.”

1.2 The following recital is added between the first and second recitals:

“AND WHEREAS the Council has by Resolution 2008-1456 passed on December 11, 2008 authorized the Chief Administrative Officer to proceed with a re-alignment of the Corporate Services Department, the Employee and Business Services Department and the Office of the Chief Financial Officer.”

1.3 The third recital is amended by adding the following thereto:

“and December 11, 2008 as the effective date for the departmental re-alignment.”

1.4 The fifth recital is amended by adding the words “and re-aligned” between the word “reorganized” and the word “structure” therein.

1.5 Section 1 of the by-law is repealed and the following substituted therefor:

“1. Every by-law in effect at the date that this by-law comes into effect is hereby amended as from that date as follows and every resolution in effect at that date shall be interpreted as follows:

(i) A reference to the position title shown in Column 1 of Table 1 of this by-law shall be a reference to the position title shown opposite in Column 2 of Table 1;

(ii) A reference to an employee by title, position, department, division or section, other than those expressly referred to in Table 1, shall be a reference to the employee designated from time to time by the Chief Administrative Officer or the department head responsible for the program to which the by-law applies; and

(iii) For the purposes of clause (ii) a designation in writing signed by the Chief Administrative Officer or a department head listed in Table 1 shall be sufficient proof of the designation for all purposes.”

1.6 A new section 2.1 is inserted immediately following section 2 as follows:

“2.1 Despite and irrespective of the applicability of Table 1, any exercise of authority or any act undertaken in good faith by a person referred to in Column 2 of Table 1 pursuant to an authority or direction previously given by Council to a corresponding person referred to in Column 1 of Table 1 shall be deemed to have been undertaken pursuant to Council authority or direction.”

1.7 Section 3 of the by-law is repealed and the following substituted therefor:

“3. This by-law as amended is effective as from December 11, 2008.”

2. That this by-law is effective as from December 11, 2008.
