THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 27-2010
 

A by-law to provide for the Regional Corporation’s consent to permit an encroachment onto parts of Regional Road 1 (Old Main Street) in the Town of Caledon.


WHEREAS, Tanya Marie Brooker, the owner of the lands and premises described as Part of East Half of Lot 9, Concession 5, West of Hurontario Street, Town of Caledon (formerly Township of Caledon, County of Peel), Regional Municipality of Peel, designated as Parts 1 and 2 on Reference Plan 43R-10850, as in PIN Number 14267-0079 has requested permission to maintain and use certain structures or improvements upon the public highway (the “encroachment”);

AND WHEREAS, pursuant to Section 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;

AND WHEREAS, the Council of the Regional Corporation has by resolution passed on the April 1, 2010 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

  1. Tanya Marie Brooker is hereby authorized to maintain the encroachments upon the public highway known as Regional Road 1 (Old Main Street), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement attached as Schedule “A” dated the 11th day of January, 2010 between The Regional Municipality of Peel and Tanya Marie Brooker, and shown on a drawing filed in Region of Peel Real Estate File ENC-93034.00.

  2. That Schedule “A” attached to this by-law is included and shall be considered part of this By-law.

  3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Clerk.
