And further, that staff provide to Regional Council details regarding Designated Smoking Rooms within the Region.

RECOMMENDATION GC-225-2002:

That the contract for Architectural Services pertaining to the development of the Joint Use Regional and Police Facility in accordance with Document Number 2002-332P be awarded to WZMH Architects in the estimated amount of $1,920,000 exclusive of disbursements and all applicable taxes;

And further, that funds for this award be provided from Cost Centre 01-7035;

And further, that staff be authorized to approve such changes, additions and or deletions as may be reasonably required for the proper management of this project, providing that they are within the approved capital budgets for the project;

And further, that staff be authorized to negotiate and execute all contracts and agreements necessary to proceed with the development of the project up to but not including construction, which will be subject to further Council authorization;

And further, that the required documents be executed by the Region's duly authorized signing officers.

MA-B1. Appointment to the Chinguacousy Health Services Board

RECOMMENDATION GC-226-2002:

That Councillor Gael Miles be appointed to the Chinguacousy Health Services Board for a term ending on November 30, 2003, or until a successor is appointed by Regional Council.

MA-B2. Region of Peel Accessibility Advisory Committee - Terms of Reference

RECOMMENDATION GC-227-2002:

That in accordance with the Ontarians with Disabilities Act, 2001 (ODA), the Region of Peel establish an Accessibility Advisory Committee to consult on the creation and maintenance of an annual municipal accessibility plan;

And further, that the terms of reference for the Region of Peel Accessibility Advisory Committee (AAC), as outlined in the report of the Commissioner of Corporate Services and Regional Solicitor, dated November 11, 2002, titled "Region of Peel Accessibility Advisory Committee - Terms of Reference", be approved;

And further, that the composition and process for the selection of members of the AAC as described in the subject report, and in accordance with the ODA, be initiated by staff;

And further, that a copy of the subject report be forwarded to the Ministry of Citizenship for their information.

MA-C2. 2003 Temporary Borrowing By-law to meet Current Expenditures

RECOMMENDATION GC-228-2002:

That the necessary by-law be presented authorizing the temporary borrowing of monies to meet 2003 current expenditures pending receipt of revenues in accordance with Section 110 of the Regional Municipalities Act, R.S.O., 1990, Chapter R.8, as amended.

MA-C3. 2003 Interim Regional Requisition By-law

RECOMMENDATION GC-229-2002:

That the 2003 interim Regional requisition be approved at a sum not to exceed 50% of the 2002 general tax levy for the Cities of Mississauga, Brampton and the Town of Caledon;

And further, that the necessary by-law be presented to Regional Council.

PW-A1. Development Charges Reimbursement - Fletcher's Meadow Developers Group, Fletcher's Meadow Secondary Plan, Various Water and Wastewater Projects - City of Brampton

RECOMMENDATION GC-230-2002:

That the Region of Peel reimburse the Fletcher's Meadow Developers Group for construction costs included in the approved 2000 to 2002 Capital Budget Program, in the amount of $3,262,118.50 for oversized sanitary sewers and watermains constructed in conjunction with the development of lands within the Fletcher's Meadow Secondary Plan, in accordance with the front-ending arrangements in the executed Subdivision Agreements and Letters of Undertaking;

And further, that upon completion of the oversized sanitary sewers and watermains, the Region of Peel reimburse the Fletcher's Meadow Developers Group for construction costs included in the approved 2002 Capital Budget Program in the amount of $1,506,870.00 for oversized sanitary sewers and watermains currently under construction, in conjunction with the development of lands within the Fletcher's Meadow Secondary Plan, in accordance with the front-ending arrangement in the executed Subdivision Agreements and Letters of Undertaking;

And further, that upon approval of the 2003 Capital Budget, the necessary funding in the amount of $876,302.00 be reimbursed to the Fletcher's Meadow Developers Group for oversized sanitary sewers and watermains constructed and currently under construction, in conjunction with the development of lands within the Fletcher's Meadow Secondary Plan, in accordance with the front-ending arrangement in the executed Subdivision Agreements and Letters of Undertaking;

And further, that funds for all projects listed are available from R3530 (Development Charge Regional Water Reserve), R3525 (Development Charge Regional Wastewater Reserve) and R3625 (Development Charge Regional Wastewater - OBL Reserve).

PW-A2. Orangeville Long Term Servicing Strategy for Water Supply and Sewage Treatment and South Arterial Road (Orangeville By-Pass) Study

PW-A4. Request for Proposal Honorarium - Northeast Brampton Feedermain, Airport Road Reservoir and Pumping Station and York-Peel Feedermain Design-Build Contracts, Project Numbers 02-1970 and 02-1916 - City of Brampton, Wards 1, 3, 7, 8, 9, 10 and 11

RECOMMENDATION GC-231-2002:

That an honorarium be provided to the unsuccessful compliant proponents at the Request for Proposal stage for the design-build contracts;

And further, that the total honorarium be $225,000 ($75,000 for each of the unsuccessful compliant proponents) with $20,587 being Peel's share for the Northeast Brampton Feedermain, Project Number 02-1970;

And further, that the total honorarium be $170,000 ($85,000 for each of the unsuccessful compliant proponents) with $124,950 being Peel's share for the Airport Road Reservoir and Pumping Station, Project Number 02-1916;

And further, that the required documents be executed by the Region's duly authorized signing officers.


PW-B. Operations and Maintenance

PW-B1. Minimum Maintenance Standards for Municipal Highways

RECOMMENDATION GC-232-2002:

That the new Minimum Maintenance Standards for Municipal Highways made under Regulation 239/02 of the Municipal Act, be endorsed;

And further, that the Region of Peel, Operations and Maintenance Roadway Performance Standards, dated August 31, 1999, as amended, be endorsed;

And further, that the area municipalities be so advised.

PW-B2. Roadside Memorials

RECOMMENDATION GC-233-2002:

That roadside memorials on Regional Road Allowances in accordance with Section 3 of the report of the Commissioner of Public Works, dated November 12, 2002, titled "Roadside Memorials", be permitted;

And further, that the subject report be forwarded to the area municipalities for their information.

RECOMMENDATION GC-234-2002:

That Regional Council endorse a water efficiency philosophy that would see consumption reductions in the order of 15% by 2013.

RECOMMENDATION GC-235-2002:

That the consulting engineering firm, AWS Engineers & Planners Corporation, be retained to provide design and contract administration services for the expansion of the McVean Sewage Pumping Station under Project Number 03-2981 at an estimated cost of $643,338 (excluding applicable taxes) in accordance with Purchasing By-Law Number 62-2001.

PW-C5. Biosolids Long Term Strategy at the South Peel Wastewater Treatment Facilities - City of Mississauga, Wards 1 and 2

RECOMMENDATION GC-236-2002:

That the long term Biosolids Strategy for Peel include the expanded use of fluid bed incineration to service growth until 2031.


PW-D. Waste Management

PW-D1. Extending the Peel Organics Demonstration Project to 2005

RECOMMENDATION GC-237-2002:

That the Peel Organics Demonstration Project in areas of Brampton, Mississauga and Caledon be extended from January 31, 2003 to April 30, 2005, with no immediate changes to the existing collection service;

And further, that staff continue to investigate the potential for expansion outside of the Peel Organics Demonstration Project areas;

And further, that the 2003 Waste Management Budget be amended to include an additional $48,000 to be provided to Project Number 98-6300 financed from the New Capital Waste Reserve (R1145).

PW-D2. Final Development of Britannia Hills Golf Course Phase II

RECOMMENDATION GC-238-2002:

That the Region of Peel enter into an agreement with the City of Mississauga for the final development of the Britannia Hills Golf Course Phase II;

And further, upon approval of the 2003 Capital Budget, $10 million be provided to the City of Mississauga from Capital Project Number 00-6240, Britannia Landfill Site Golf Course (Phase II) for the project construction costs including all operating costs sustained during the grow in periods in 2003 and 2004;

And further, that in accordance with Purchasing By-Law 62-2001, Direct Negotiation Section 5.2.5, Ted Baker and Associates be authorized to undertake the final golf course design and associated works for an additional commitment of $37,664 plus applicable taxes to their existing purchase order for the Britannia Hills Golf Course Phase II for a total commitment of $204,862.20 plus applicable taxes from previously approved Capital Project Number 99-6230;

And further, that the required documents be executed by the Region's duly authorized signing officers.

That in accordance with Procedural By-law 54-1999, as amended, Section III-2(i), be waived in order that the December 5, 2002 General Committee meeting continue past 3:30 p.m. to complete the remaining items on the agenda.

PL-B. Planning Policy and Research

PL-B1. Oak Ridges Moraine Conservation Plan - Achieving Conformity

RECOMMENDATION GC-241-2002:

Whereas the Provincial government has committed to developing and maintaining a data management system to collect, store, update and share natural heritage, water resources and geotechnical information needed to interpret, apply and monitor the policies of the Oak Ridges Moraine Conservation Plan (ORMCP);

And whereas the Provincial government has committed to updating existing technical guidelines and developing new ones as required to help the users of the ORMCP to better understand, interpret and implement the policies of the Plan;

And whereas primary responsibility for detailed implementation of the ORMCP rests with the Town of Caledon and any local implementation guidelines are most appropriately developed by the Town of Caledon in consultation with appropriate stakeholders;

And whereas the Town of Caledon requires the Regional ORMCP Conformity Amendment to provide sufficient flexibility to allow the Town to explore, through the preparation of the local ORMCP Official Plan Conformity Amendment, alternatives for addressing and resolving various detailed policy issues and concerns;

And whereas further clarification is required regarding the jurisdiction of the Ontario Municipal Board with respect to ORMCP conformity issues after the initial round of conformity amendments have been approved by the Minister;

And whereas these matters require further discussion between Regional Councillors and planning and legal staff of the Region of Peel and Town of Caledon prior to the draft Regional ORMCP Conformity Amendment being released to the public for review;

Therefore be it resolved that Planning staff be directed to revise the preliminary draft Regional ORMCP Conformity Amendment to delete proposed sections 7.2.6.10, 7.6.2.11 and 7.9.2.7 and to delete the second last sentence of proposed section 2.2.9.3.5 c);

And further, that Regional planning staff be directed to hold a series of meetings with interested Regional Councillors and planning staff from the Town of Caledon to ensure that issues of local flexibility and the Ontario Municipal Board's jurisdiction with respect to the ORMCP are resolved and the draft Regional ORMCP Conformity Amendment revised accordingly, prior to the release of the draft conformity amendment to the public for review.

F1. Impact of Growth on Emergency Services

RECOMMENDATION GC-242-2002:

That all development applications be circulated to the Halton-Peel District Health Council for comment and their comments be included in the report to the Regional Council;

And further, that we again appeal to the Government of Ontario to reestablish the Development Levy for Hospitals;

And further, that a report be presented to Regional Council in January 2003 with the necessary data to support this request.

F2. Development Charges in Peel Region

RECOMMENDATION GC-243-2002:

Whereas there is a need for the Region of Peel to negotiate with the Province of Ontario to change the criteria for development charges, prior to the five-year review;

Therefore be it resolved that a report be presented to the first Regional Council meeting in January on the changes that need to be made with respect to development charges to meet the community needs for capital projects, for all levels of services, including hospitals and school buildings;

And further, that the Province of Ontario be requested to fund all available beds.
