2. DECLARATIONS OF CONFLICTS OF INTEREST

a) Councillor Hughes declared a conflict of interest with respect to In Camera Item g) regarding Appeals of the Region of Peel Official Plan (ROP) relating to the aggregate issue. He stated that he is an appellant to the Ontario Municipal Board (OMB) on the Minister s modifications of the mineral aggregate section of the Regional Official Plan, as the property where he resides is affected by the Minister s modifications. Pursuant to the Municipal Conflict of Interest Act, he refrained from the discussion and voting thereon.

And further, that the section of Highway 50, from Regional Road 15 (Steeles Avenue) to Highway 7, in the City of Brampton, be assigned Regional Road Number 24 as a result of the April 1, 1997 transfer of this road section from the Ministry of Transportation of Ontario to the Regional Municipality of Peel;

That any existing homes abutting the Bolton/Brampton Trunk Sewer, from the McVean Drive Pumping Station, in the City of Brampton, to south of the Bolton Settlement Area, in the Town of Caledon, be allowed to connect to the trunk sewer under the following conditions:

a) the existing private system has failed, or cannot meet the current standards;

b) repair or replacement of the private system is not environmentally or economically practical;

c) construction of a new home on an existing lot of record; And further, that expansions to existing uses, such as additions, be considered for connection to the sewer, subject to the conditions indicated above;

And further, that redevelopment or new development applications not be considered for sewer connections.

14. BUSINESS ARISING FROM IN CAMERA MATTERS

a) Litigation or potential litigation, including matters before administrative tribunals, affecting the Regional Corporation.

Seconded by Councillor Mahoney;

Whereas the Region of Peel supports the intent of Section 19 (3) of the Assessment Act in protecting farm lands used for farm purposes;

And whereas, in recent years this section of the Act has been used to obtain assessment reductions for properties which are not farm lands used for farm purposes;

And whereas, farming is a legal non-conforming use of lands zoned for other purposes, but only when the farming of these lands has been continuous;

And whereas, the recent Ontario Municipal Board (OMB) decision regarding Slough Estates Limited, Menkes Development Corporation Limited et al will cause Peel taxpayers to incur a significant loss in tax revenues as a result of inappropriate farm assessments being applied to non-farm properties in the City of Mississauga, the City of Brampton and the Town of Caledon;

Therefore be it resolved, that the Region of Peel seek permission from the Court to intervene in the Court proceedings in order to support the City of Mississauga in the matter of its leave to appeal the OMB decision Slough Estates Limited, Menkes Development Corporation Limited et al to the Divisional Court.

Three Readings

By-law 51-97: To authorize the construction of a local improvement sanitary sewer on Spring Road from the easterly portion of Greenoaks Drive to just short of the westerly portion of Greenoaks Drive, a total distance of 165 metres (541 feet), more or less, in the City of Mississauga.

By-law 52-97: To authorize construction of a watermain on Mount Pleasant Road a total distance of 750 metres (2460 ft) more or less, in the Town of Caledon.

By-law 55-97: To provide for the Regional Corporation's consent to permit an encroachment onto parts of Regional Road Number 1 Olde Main Street, in the Town of Caledon (Belfountain).

Whereas the Municipal Act RSO 1990, as amended, stipulates that the seat of a member of Council becomes vacant if the member is absent from the meetings of Council for three successive months without being authorized by resolution of the Council entered in its minutes;

And whereas, Councillor Frank McKechnie for health reasons has been required to be absent from meetings of Regional Council since April 24, 1997;

And whereas, it is the wish of this Council that the office of Councillor Frank McKechnie not be jeopardized because of his illness;

Therefore be it resolved, that Councillor Frank McKechnie be authorized to be absent from meetings of Council for more than three successive months.

That Resolution 97-721 regarding Lester B. Pearson International Airport operating area passed by Regional Council on June 26, 1997 be amended to read:

Whereas many of the complaints that are received regarding airport operation are generated in the area of 30 NEF and lower because of low flying aircraft;

And whereas, the Region of Peel continues to support the economic viability of the airport;

And whereas, planes at Eastgate Parkway and Eglinton Avenue East are 601 feet above ground level and are approximately 800 feet above ground level at Eastgate and Parkway Belt Westlands;

And whereas, the City of Mississauga has recognized the problems with the Lester B. Pearson International Airport Operating Area up to and including Eglinton Avenue and beyond;

Therefore be it resolved, that the Lester B. Pearson International Airport Operating Area be reviewed by the Greater Toronto Airports Authority (GTAA), the City of Mississauga, the City of Brampton and the Region of Peel before the new runways become operational.

That the Chief Administrative Officer be authorized to approve the purchase of services of outside legal counsel and of consultants to give expert evidence as may be necessary to defend the appeals of the Regional Official Plan (ROP);

And further, that a capital project be established as Project 97-7820 Regional Official Plan Appeals to cover costs associated with the defence of all Regional Official Plan appeals in the amount of $500,000, to be funded from the Working Funds Reserve;

And further, that Regional Council adopt the position that the Region be afforded the opportunity at the prehearing conference scheduled for August 21 and 22, 1997, by the Ontario Municipal Board (OMB) in its decision of June 23, 1997, to request that the hearing on aggregate appeals follow the hearing on the airport appeals;

And further, that Regional Council request the Town of Caledon support its position on the date of the hearing and the process for addressing the date of the hearing.

Whereas at a Prehearing Conference on July 4, 1997, with respect to the airport related appeals of the Regional Official Plan (ROP), the Ontario Municipal Board (OMB) determined that the hearings on the appeals of the ROP will be held in the following sequence at the following commencement times:

All appeals other than those relating to aggregate and airport - October 21, 1997
Aggregate related appeals - November 17, 1997
Airport related appeals - January 5, 1998

And whereas, in a written disposition issued on June 23, 1997, the OMB scheduled a Prehearing Conference on August 21 and 22, 1997 for, among other things, determining the precise timing of the hearing for aggregate related appeals;

And whereas, there are almost 100 aggregate related appeals;

And whereas, very few of the aggregate appellants were present at the Prehearing Conference on July 4, 1997;

And whereas, a substantial amount of time will be required to prepare for the hearing on the aggregate related appeals;

Therefore be it resolved, that the Region of Peel request the OMB to change the start date of the hearing of the aggregate related appeals from November 17, 1997 to follow the conclusion of the hearing on the airport related appeals, which is expected to be concluded in January 1998;

And further, that the Commissioner of Corporate Services and Regional Solicitor write to the OMB expressing the Region of Peel s concern about the OMB proceeding on July 4, 1997, to schedule a hearing date for the aggregate related appeals when the OMB has said, and all the aggregate appellants were under the impression, that a hearing date would not be set until the Prehearing Conference on August 21 and 22, 1997;

And further, that a copy of this resolution be forwarded to the Minster of Municipal Affairs and Housing.
