Notice of Adoption
With respect to Regional Official Plan Amendment No. 28 By-law 36-2014

TAKE NOTICE that the Council of The Regional Municipality of Peel passed By-law 36-2014 on April 24, 2014 to adopt Regional Official Plan Amendment 28 under Section 17 of the Planning Act, R.S.O. 1990 c. P. 13, as amended (the “Act”).

The purpose and effect of Regional Official Plan Amendment 28 is to expand the Rural Service Centre Boundary for Bolton in Schedule ‘D’ of the Regional Official Plan to include 200.1 ha of additional land and remove the 200.1 ha from the Prime Agricultural Area identified in Schedule ‘B’ of the Regional Official Plan.

Information in respect of Regional Official Plan Amendment 28 and By-law 36-2014 will be available to the public for inspection at Region of Peel Development Services located at 10 Peel Centre Drive, Suite A, 6th Floor, Brampton, Ontario, L6T 4B9. A copy of Regional Official Plan Amendment 28 and By-law 36-2014 are also available for review on the Region of Peel’s website at http://www.peelregion.ca/council/bylaws/2010s/2014/by36-2014.htm

The last date for filing a notice of appeal of Regional Official Plan Amendment 28 is May 26, 2014. The notice of appeal:

  1. must be filed with the Regional Clerk;
  2. must set out the reasons for the appeal, and the specific part of Regional Official Plan Amendment 28 to which the appeal applies; and
  3. must be accompanied by the fee required by the Ontario Municipal Board in the amount of $125.00, which can only be paid by certified cheque or money order made payable to the Minister of Finance, Province of Ontario.

Regional Official Plan Amendment 28 is exempt from approval by the Minister of Municipal Affairs and Housing. The decision of the Council of The Regional Municipality of Peel is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

Only individuals, corporations or public bodies may appeal a decision of the municipality to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before Regional Official Plan Amendment 28 was adopted, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.

A portion of the lands affected by Regional Official Plan Amendment 28 are subject to a Minister’s zoning order as in Ontario Regulation 210/13 made pursuant to the Act.
